JAKARTA (tandaseru.id) – WNA atau orang asing berhak memiliki KTP-el. Hal ini diatur dalam Pasal 63 ayat (1) UU No. 24 Tahun 2013 tentang Adminduk.
Dalam pasal tersebut menyebutkan penduduk WNI dan Orang Asing yang memiliki Izin Tinggal Tetap yang telah berumur 17 tahun atau telah kawin atau pernah kawin wajib memiliki KTP-el.
Direktur Pendaftaran Penduduk David Yama menjelaskan memiliki KTP-el adalah hak bagi penduduk yang telah menginjak usia 17 tahun, pernah menikah atau telah menikah dan merupakan kewajiban pemerintah untuk memenuhinya.
“Setiap Warga Negara Indonesia dan Orang Asing yang bertempat tinggal di Indonesia wajib kita penuhi haknya memiliki KTP-el bagi yang memenuhi syarat,” jelasnya Kamis (10/3).
Menteri Dalam Negeri Tito Karnavian juga menjelaskan bahwa pemberian identitas resmi kepada WNI ataupun orang asing harus dilakukan sesuai amanat undang-undang dan dalam koridor yang benar.
Lantas bagaimana syarat Orang Asing agar dapat dibuatkan KTP-el?
Dirjen Dukcapil Kemendagri Zudan Arif Fakrulloh kepada wartawan, Kamis (10/3) menyampaikan penduduk orang asing yang sudah berumur 17 tahun atau lebih, atau sudah menikah, dan memiliki izin tinggal tetap serta dokumen perjalanan, wajib memiliki KTP elektronik. Itu perintah UU.”
“Jadi Dukcapil itu kan bekerjanya di hilir, kalau ada izin tinggal tetap dari imigrasi, kami terbitkan KTP-el, kalau tidak ada, tidak kami terbitkan,” kata Zudan.
Izin tinggal tetap itu, lanjut Zudan, menjadi penentu terkait masa berlaku KTP-el tersebut.
Dia mengatakan, jika izin tinggal tetap tersebut berlaku selama setahun, maka KTP-el milik WNA tersebut juga akan berlaku selama setahun.
Zudan menekankan bahwa KTP-el tersebut dapat dimanfaatkan orang asing untuk memperoleh pelayanan publik seperti layanan kesehatan maupun perbankan, namun tidak memiliki hak politik seperti suara dalam pemilu.
