Sosialisasi Pergub 53 Tahun 2020 Diperpanjang Hingga 20 September
SURABAYA (tandaseru) – Pergub Jatim Nomer 53 Tahun 2020 telah ditandatangi Gubernur Khofifah Indar Parawansa sejak 4 September dan diundangkan pada 7 September 2020. Sedianya Pergub tentang Penerapan Protokol Kesehatan dalam Pencegahan dan Pengendalian Corona Virus Disease 2019 itu disosialisasikan selama tujuh hari sebelum dan diterapkan mulai 14 September kemarin.
Namun berdasarkan koordinasi Kepala Satpol PP Jatim, Budi Santosa bersama Sekdaprov Jatim, Heru Tjahjono dan Kapolda Jatim, Irjen Pol Muhammad Fadil Imran, diputuskan masa sosialisasi diperpanjang. Perpanjangan itu dilakukan hingga 20 September mendatang dan pada 21 September untuk penegakan hukum sanksi administratif dari Pergub 53 itu mulai diberlakukan.
“Jadi saya sudah rapat dengan Pak Kapolda Jatim dan Pak Sekdaprov. Sesuai arahan Pak Kapolda, sosialisasi minta diperpanjang sampai 20 September, dan pada 21 September. Tetapi selama masa sosialisasi, teguran lisan dan tulis itu masih ada. Penyitaan KTP, pembubaran kerumunan masih ada tetap,” ujar Budi, Rabu (16/9).
Budi mengakui, ada beberapa daerah yang sudah menerapkan sanksi administratif sesuai Perwali dan Perbup. Di mana nilai sanksi administratifnya berbeda dari Pergub. Seperti di Sidoarjo dan Gresik yang menerapkan sanksi denda Rp 150 ribu kepada pelanggar protokol kesehatan.
Sedangkan di Kota Surabaya, sanksi administratif berupa denda, diakui masih belum diterapkan. Tetapi untuk sanksi sosial dan penyitaan KTP sudah dilakukan. “Kan memang ada dari kabupaten/kota yang sudah melaksanakan sanksi Tipiring (Tindak Pidana Ringan), denda sesuai perwali dan perbup masing-masing,” ujarnya.
Dalam perpanjangan masa sosialisasi tersebut, Budi menjelaskan Satpol PP diminta untuk menyiapkan tim yang baik. Diikuti dengan persiapan berkas-berkas yang baik untuk menegakkan protokol kesehatan. “Kita juga diminta, agar saat petugas di lapangan yang menegakkan protokol kesehatan harus melibatkan hakim untuk Tipiring,” imbuhnya.
Budi menambahkan, pihaknya dan Polda Jatim sepakat akan menerapkan sanksi administratif untuk semua daerah di Jawa Timur per tanggal 21 September 2020. “Sosialisasi ini, agar memberi persiapan yang matang. Arahan dari Pak Kapolda juga, nanti diminta ada mobil khusus untuk pemburu pelanggaran protokol kesehatan di Jatim,” ujarnya.
Dalam Pergub 53 dijelaskan tentang kewajiban bagi perorangan untuk menggunakan masker menutupi hidung, mulut, hingga dagu. Selain itu wajib cuci tangan pakai sabun dengan air mengalir atau gunakan hand sanitizer, menjaga jarak dan menerapkan pola hidup bersih dan sehat.
Pergub juga mengatur penerapan sanksi administratif bagi pelanggar protokol kesehatan bagi perorangan. Mulai teguran lisan, paksaan pemerintah dengan membubarkan kerumunan dan penyitaan KTP, kerja sosial, serta denda administratif sebesar Rp 250 ribu.
Selain sanksi bagi pelanggar perorangan, sanksi juga diberlakukan pada sektor pelaku usaha, pengelola, penyelenggara, atau penanggung jawab tempat dan fasilitas umum. Adapun kewajiban bagi pelaku usaha yakni ikut menyosialisasikan dan mengedukasi masyarakat yerkait pencegahan dan pengendalian Covid-19.
Selain itu, menyediakan sarana cuci tangan dengan sabun atau hand sanitizer, pengaturan jaga jarak, penyemprotan disinfektan secara berkala, hingga melakukan upaya deteksi dini. Untuk sanksi administratifnya secara berjenjang, berupa teguran lisan atau teguran tertulis, penghentian sementara kegiatan, denda administratif, hingga pencabutan izin usaha.
Adapun denda administratif bagi pelaku usaha diklasifikasikan sesuai besaran usaha. Bagi usaha mikro denda sebesar Rp 500 ribu, usaha kecil Rp 1 juta, usaha menengah Rp 5 juta, dan usaha besar Rp 25 juta. Bagi pelaku usaha yang kembali melakulan pelanggaran akan dikenakan sanksi denda administratif dua kali lipat dari denda pertama. Sedangkan pelanggaran ketiga adalah pencabutan izin usaha.
Pembayaran denda administratif itu dilakukan melalui Rekening Bank Jatim nomer 0011000477. Bukti pembayaran ke Kas Daerah itu digunakan untuk pengambilan KTP yang telah disita.
